Permit Application 2014-for 2015 Permit

The new permit cycle is 2013-2018, but since the State cannot process all the permitees in 2013, they are staggering the dates for application based on watersheds.  For Genesee County communities, that means that in 2014 we will be reapplying for a new permit effective in 2015.

      ·         Fall 2013: New permit training by MDEQ  
·         Winter 2013: Meetings with MDEQ

April 1, 2014: Applications for new permit due

Fall 2014: approval of application.  Permit Effective 2015

o   Your application contact, stormwater program manager and you contact for stormwater billing can all be the same person or you may want a different person in your organization for each.

·         Section III:  Check the 2nd  box.(Reissuance of Previous authorization) This changed on 3/4/2014 2PM

o    NOTE: Genesee Twp is required to add actions to address the Mott Lake TMDL.(box 3) You should have been notified by the MDEQ if to have  a new TMDL requirement. 

·     Section IV & V: Maps/table 1: click on your community name below to get a pdf of the map/table 1. Include them in your application as Attachment 1.

Section VII:    Storm Water Management Program

When answering the questions in this section of the application, the applicant’s MS4 encompasses what the applicant identified in Sections IV, V, and VI, above. The applicant shall include a measurable goal for each BMP. Each measurable goal shall include, as appropriate, a schedule for BMP implementation (months and years), including interim milestones and the frequency of the action. Each measurable goal shall have a measure of assessment to measure progress towards achieving the measurable goal. A United States Environmental Protection Agency (USEPA) guidance document on measurable goals available at http://www.epa.gov/npdes/pubs/measurablegoals.pdf.

Please look over this measurable goals document.  you must tell the MDEQ your measurable goal for each section in this permit application.

o    Enforcement response Procedure (ERP):  The enforcement response plan for an illicit discharge is in the revised IDEP plan.

-Note the IDEP plan explains the procedure you will follow.  You still need to provide the legal authority you have for enforcing IDEP violations. Your community may or may not already have an existing ordinance (such as a nuisance ordinance).  You may have to pass an IDEP ordinance (cities) or a regulatory mechanism (townships) if you do not already have authority.  If so you need to provide a schedule of when this will be done by before Oct 1, 2014.

"At a minimum, existing staff shall be trained at least once during the permit cycle and new hires within the first year of their hire date. The program shall include a training schedule for the permit cycle. It is recommended that staff is trained more than once per permit cycle." (Attachment 2, page 11 of  IDEP plan)

You can use any IDEP ordinance you choose, but if you do not use Model Idep Ordianance,  I suggest that you have Stephanie check it over to make sure it will not comflict with the NPDES PH II permit]
TOWNSHIPS: You will need to review your exisitng ordinances/ resolutions/ procedures to determine if you already have authority to prohibit non storm water discharges into your MS4's. (properties/storm sewer systems) you own.  If you do not you will have to pass a resolution or other regulatory mechanism that will hold up in court.  (you may want to pass an  IDEP Ordinance, although it is not required).  This will have to be done by Oct 1, 2014.  you may get your own language or the subcommittee will develope an appropriate template place here.

Based on the information that you compiled for question 20, please answer question 21 & 22.  NOTE: although as a permittee you never want any of your ordinances/ regulatory mechanisms having you AUTHORIZE an illicit discharge, there are non storm water discharges that you do not have to prohibit. (outlined in 21 & 22)
-23 through 26.  (Attachment 2, Attachment __ to ) make sure you accuratly reference where Stephanie can find this item.  It is going to be different for everyone. 
-23: Spoke to Stephanie.  The language is out of the EPA's draft IDEP ordinance.  Any IDEP ordianace or regulatory mechanism  you adopt should have in it's purpose "the intent is to regulate the contributions to the MUNICIPAL NAME's MS4s".  Then reference it in the application where it can be found in the ordianance/ regulartory mechanism.

o   Construction Storm Water Runnoff Contorl Program:

o   Post-Construction Storm Water Runnoff Contorl Program: This is the ordinance that the BMP subcommittee has been working on for a couple of years.  This has to do with how you enforce storm water quantity and quality measures on a private development after construction that is draining to your MS4's.

o   Pollution Prevention and Good Housekeeping Program: This is where you have to describe your properties, your MS4s, your good housekeeping practices.  We went through this in 2010-2011 and created a MPPP.  also some of you had staff that took the storm water operator training, and created SWPPP for you high potential for pollutant sites (such as DPW yards, fueling stations, automotive maintenance facilities, fleet maintenance, stockpile areas, composting facilities, etc...)  If you have your MPPP or your SWPPP done then you can use them to answer these questions.  You have also answered questions in regards to this in you SWPPI Goal 6 and 7.  The level of detail in your SWPPI is not sufficient for this permit application.

QUESTIONS 64 through 68 have to do with High potential site you own.  Unless you are a small Township and own nothing but parks and a Hall, you are probably going to have to fill these questions out.

Under Training it has the manuel for Good housekeeping.  You can use or adopt if you wish.

The Industrial program manual has guidance in the appendix on how to develop SOP's for your facilities. Also some specific SOP guidance.
-64: If you have a DPW yard, fueling stations, fleet maintenance, storage yards, etc., then in 2010-2011 your community should have had an employee get trained with the industrial storm water training.  Created a SWPPP for these High potential sites (previously referred to as facilities).  The SWPPP is your SOP.  It has a map of the site, where the storm sewers are located and drain to, what structural and non-structural controls are in place, an inspection schedule, documentation of maintenance and inspection reports, and who is responsible for oversight (storm water operator).   Fill out Yes or N/A as appropriate in permit application.

August 2015 the MDEQ launched their MI Waters program.  All water related permits must be submitted through this program.  September 2015 newsletter is a link to instructions to how to set up a MI Waters account.

Additional information

ILLICIT COMPLAINT FORM: When a community gets a complaint that someone is illegally dumping into a storm catch basin, ditch or watercourse, whoever takes the complaint should complete this form to make sure the call gets followed up.
